I was married with my ex husband for 7 years only, and he remarried 2 years ago and we have three kids together and he's not paying child support, how can my children get some benefits from his social security?

There are three types of Social Security benefits which the children may qualify for regarding your ex-husband :

  • Survivor benefits based on ex-husband's death
  • Disability benefits based on ex-husband's disability
  • Retirement benefits based on ex-husband's retirement

From what I have seen your child can get benefits if he or she is the biological child, adopted child or dependent stepchild.
