ex-wife other people's social security numbers

My ex-wife applied and got a credit card in our minor daughter's name. On the on line application to the bank she used out daughter's name, employer, a fake age and a fake social security number. My ex maxed out the card. My daughter's credit report shows my ex has used my daughter's identity for years
My ex wife's credit report is part of State Court records and shows she is using different social security numbers not assigned to her.

The Sheriff's office did a report on it but no prosecution in 2009.
In a letter the States Attorney and SD Attorney General say that since my ex was convicted of identity theft in 2005 that they can not prosecute her for crimes she did in 2009 involving identity theft.

My ex-wife has used various social security number since her 2005 conviction for identity theft. Is this not illegal and why no prosecution?
