Can ex-husband legally keep daughter's backpay from SSI

My daughter received a large SSI backpay check a few months ago due to my husband's disability. He took the money from me and hid it. I am the designated payee for her because she is a minor. He claims it is his money and his right to hold it back from her. If she and I move out would he be forced to turn over the money to me (for her day to day needs and saving)? Also, would she continue to get her monthly benefits even if she does not live in his home?

You mention you're the "designated payee". Social Security refers to a "Representative Payee" who should receive benefits on behalf of a child or another who may have trouble managing benefit payments. If you're the "Representative Payee" recognized by Social Security you should have a strong case regarding control of the back payment and future benefits.
