2003. Administrative Actions that are not Initial Determinations

2003.1 What is the review process for administrative actions that are not initial determinations?

We may review administrative actions that are not initial determinations. These actions are not subject to:

  1. The administrative review process; and

  2. Judicial review.

2003.2 What actions are included?

Administrative actions that are not initial determinations include:

  1. Withholding part of a monthly benefit to recover an overpayment, authorizing fees for representation; and

  2. Denying a request to extend the time period to request review of a determination or decision.

Other administrative actions that are not determinations are listed in our regulations.

This year I got a divorce and did not get my mail, Soc sec had sent a letter that I did not get for a medical review, they stopped my payments as a result of this. It is June and my payments stopped in March. One month ago I went to the Local Social Security office and provided them with the information they needed, as a result they told me that I should start receiving payment soon. It has been one month and I still haven't started to receive payment again or received mail to inform me of a new appointment for a medical review. Is this a big deal? are they going to make me go through the whole process? When I call the 800# all they can tell me is that it is review. I am going back to my local office tomorrow, but I was wondering if anyone had been through this? do I need an attorney? Help I need to receive this asap, I have no income.
