I went into the Muncie office last week to talk to someone about survior benefits. The lady told me about being age 50 or disabled and tried to send me on my way, I asked to speak with someone because I read more and I meet requirements. A lady came up to me and said the first lady was right. I said I wanted to speak to someone of fill out application. She said she is a claims person and there is no application. They would not help me or look up my question. She told me to come back with the proof. Below is the proof. I will see you in a couple of days. I hope I can be treated with some respect and empathy as my children's father just passed.

If you have been divorced, your former wife or husband who is age 60 or older (50-59 if disabled) can get benefits if your marriage lasted at least 10 years. Your former spouse, however, does not have to meet the age or length-of-marriage rule if he or she is caring for his/her child who is under age 16 or who is disabled and also entitled based on your work. The child must be your former spouse's natural or legally adopted child.

Here is another response to lady at the Muncie office who told me I can't fill out an application there. The whole experience was completely wrong. I will be in the office on Tuesday and will continue to file complaints as well as actually speak to an informed and polite agent and fill out an application to what I am entitled to.

1505.1 Where do you file your application for Social Security benefits?
File your application for Social Security benefits:

At a Social Security office or with an authorized Social Security employee (Retirement, Spouse and Disability applications may be filed on the Internet at http://www.socialsecurity.gov);

Yes, it sounds you may qualify for "Mother's Benefits" if you are caring for a dependent child of the deceased.

A former spouse, however, does not have to meet the age or length-of-marriage rule if she or he is caring for their natural or legally adopted child who is younger than age 16 or who is disabled and also is entitled based on the deceased worker's work.
