What if a person recieving ssi went to prison and their payments were stop due to incarenration, would they be able to restart their benefits when they get out and would they be back pay for the months they were in prison
SSI benefits and jail or prision
If you get a monthly SSI check and you are in jail, your SSI check will stop after you are in jail for a full calendar month.
For example, if you were in jail on March 21, 2001 and you stay there to serve a three-month sentence, your check will stop beginning with April 2001.
Contact your local Social Security office and bring your proof of release from jail to restart your monthly benefits.
You must report to the SSA if you are confined in jail. Failure to report, and continuing to receive benefits, may result in an "overpayment" which you may have to pay back to the SSA.

Ex husband incarerated and child receiving benefits
My ex husband is currently receiving Social Security Disability payments which means our son is also receiving monthly benefits. My ex has been arrested and I need to know if our son's benefits will stop also if his dad is in jail for longer than 30 days.
Benefits for dependents will continue despite parent in jail
If your son was receiving Social Security benefits before your ex-husband's incarceration, benefits to your son will continue while he is incarcerated.
