Ex Husband Death Benefits

I am 52, divorced after 23 years of marriage to Ex husband. Ex was killed last year, but he had remarried 3 months after our divorce was final, so had been remarried for five years. I remarried three years ago. Am I eligible once I reach 60 for the Ex's benefits?

Generally, the SSA does not pay survivor or retirement benefits if the divorced spouse remarries someone other than the former spouse, unless the latter marriage ends (whether by death, divorce, or annulment).

In particular, if you remarry before you reach age 60 (age 50 if disabled), you cannot receive benefits as a surviving spouse while you are married.

If you remarry after you reach age 60 (age 50 if disabled), you will continue to qualify for benefits on your deceased spouse's Social Security record.
