Filing as a survivor now

I'm divorced after 22 years of marriage and my former spouse is deceased. I know I can file based on his earnings record. My question is - if I file at age 63 on his record and then file at age 70 based on my own record, is there a penalty?

I recommend contacting Social Security regarding this. The following excerpt doesn't match your case exactly, but it is a similar situation :

If you are getting benefits based on your own work, call or visit us, and we will check to see if you can get more money as a widow or widower. If so, you will receive a combination of benefits that equals the higher amount.
