Old sales Commission payment from last job. Paid years later?

I have just received a commission check for a sale made while employed. The sale was three years ago. Before SSDI award. Who and how do I report money paid me two weeks ago for a sale before SSDI award. The sale was made in 12-08 and the check 12-15-11? Thank you and appreciate your help.

I assume you're receiving "normal" SSDI rather than SSI. SSI recipients must report essentially ALL income and assets.

For your case, I would be inclined to not report the income for Social Security disability purposes. Of course you will have to report it for income tax purposes.

Social Security documents state the following :


If you work while receiving disability payments

You should tell us if you take a job or become self-employed, no matter how little you earn.

In this case, you did not "start" (take) a job or become self-employed after the disability. Of course you may get a 1099 or W-2 for this income, and the SSA may see this 1099/W-2 record. In this case, you will want to have evidence that the payment was for work done BEFORE the disability.

You may want to call the SSA, perhaps anonymously, regarding this.

Thanks for the reply. This seems to be the answer, the RIGHT answer to the question I posed regarding these circumstances. Being...I was sent a payment check for work done before I went on SSDI. Then it is true that I took no, started no Job and/or did not became self-employed to gain this or any other monies. Reading what you included above:

I report the money was earned from work done long before I was on SSDI. So to that fact and still the fact is I never took a job or worked as a Contractor so...and therefore I have no regular income after becoming a SSDI award. I still want to report the income and I do have original documentation showing the sale occurred before the SSDI award.

OK, the beating of a dead horse...should I just report the income and wait for them to ask for proof? Or as I think Report the income and include the sales documentation. Reason. When the sale was first closed it was for an certain amount. I went out on Disability and the customer added items as the order was meandering thru the order system. It ended up being sent to the factory in Italy as a little larger order then what I closed. I was given credit as the original salesman but I had no input or did any work since I was out on SSID by this time.

Report....Report and wait for requests on info...Report with all the documentation I can supply showing the order timeline and history?

I would contact Social Security directly (and anonymously) and get their response.

However, if you don't receive a clear answer, I would report the income, but I would attach documentation showing this was deferred income for work done before the disability.

Keep copies of the communication.

If possible, I'd also wait until January 31 which is the due date for you to receive a W-2 or 1099-MISC regarding this income. If the W-2/1099 ascribes the income to years ago, this will bolster your case that it happened before your disability.
