Parents separated Dad is representative payee Mom has kids

Dad and Mom have two adopted children of the marriage. The children receive Social Security benefits and Dad is the Representative Payee for both children. The parties receive monthly Adoption Assistance funds and Dad has that paid via direct deposit to his account. The parties separated and Dad left the home. Mom has the kids full time and Dad is taking all the Social Security money and the Adoption Assistance funds and not giving Mom any of the funds. What does Mom need to do to start getting the benefits on behalf of the children?

Go to Social Security and make them aware of what is happening. Ask social security to make mom the payee or at least make a third party the payee such as a non-profit organization. For the Adoption assistance fund mom should go to the agency providing those funds also and make them aware of the situation.

I think also you should immediately get the courts involved as far as who has legal custody of the kids and the judge can rule on who should receive the funds.
