Collecting my deseased husband unclaimed benefits

Ok, lets see if anyone can figure this out...I am already receiving SSI, on section 8 and claiming my husbands SS. My husband recently passed however he was in the hospital from 01/25/2010 and then died 03/11/2010...I already received the 255.00 for bereavement which I know that I'm intitled to, however....what about the unclaimed benefits from him from the time he was in the hospital thru the time he died....thats a month in a half of unclaimed benefits...I know that i'm intitled to it, however, the social security office in modesto, ca. told me that I would need to worry about section 8...when I spoke with section 8, they laughed and said that it would not effect section 8, but social security might 6 months down the road give me problems....I need to pay my husband bills with that money...like his cremation....how is this going to effect me in the long run...

3-23-2010 You need to at least consult with an attorney who specializes in Social Security Disability cases to have your situation evaluated to determine if in fact you are entitled to anything or whether you have just been given the "run-around".

Social Security benefits are not paid for the month in which an individual dies. Example: An individual receives a Social Security check in June for the month of May, and dies after the receipt of that payment. The individual would be entitled to the check received in June (May's payment) because the individual lived throughout the month of May. However, the check issued in July (for the month of June) would have to be returned to Social Security because the individual did not live throughout the month of June.
