Hi, I'm 18 and i receive SSI monthly. The problem im having is my mother is the Rep. payee and when she cashes the check she goes straight to the casino or she spends it on ridiculous things when we need basic stuff we cant get it cause the spends the money. She is also not in the right mental state to manage money as I think shes a schizophrenic cause the has all the signs but wont get help. I was wondering what can i do to get the check in my name. Any help is greatly appreciated.
Change of payee away from mother
If you're 18 or older, you may be able to remove your mother as the representative payee. If you're under 18, generally you need a representative payee.

Here is a form one can use to be selected as a representative payee :

Change of Payee.
You need to consult with the Social Security Office about changing your payee. I don't see why they cannot change your check in your name? You are now 18 years old; therefore, the SS office can file that for you. Unless there are other legal matters that prevent you from being your own payee, but seek your local Legal Aid office for help. They are there to help low-income individuals in certain matters that may relate to yours. Check your with them and hopefully, someone will help you with that. Take care and hope your situation improves.
