Benefits from ex-husband

I was told I would get benefits since we were married over 10 years, and could get those benefits even if he did not retire at 62. But does the fact that he married after our divorce and divorced her approximately 10 years later nullify my receiving benefits, even though I never remarried?

Please check with SSA for your individual case, but you should receive benefits on your ex-spouse's record (even if he or she has remarried) if:
* Your marriage lasted 10 years or longer;
* You are unmarried;
* You are age 62 or older;
* The benefit you are entitled to receive based on your own work is less than the benefit you would receive based on your ex-spouse's work; and
* Your ex-spouse is entitled to Social Security retirement or disability benefits.

Am in the process of a divorce after being married 50+ years. I make less SS benefits then my husband. Am i able to collect half of his SS benefits plus collect mine?

I'm 59 and planning my retirement. I was married more than 10 years. Can I draw 1/2 of my X husband's benefits from 62 to 70? He is not retired and doesn't plan to retire until he is 70. I been told many different things about this situation. It is really important and helpful in my planning if I know the answer in advance.

If you are divorced, but your marriage lasted 10 years or longer, you can receive benefits on your ex-spouse's record (even if he or she has remarried) if:

  • You are unmarried;
  • You are age 62 or older;
  • Your ex-spouse is entitled to Social Security retirement or disability benefits AND
  • The benefit you are entitled to receive based on your own work is less than the benefit you would receive based on your ex-spouse's work.

If your ex-spouse has not applied for retirement benefits, but can qualify for them (is age 62 or higher), you can receive benefits on his or her record if you have been divorced for at least two years.

Note: Your benefit as a divorced spouse is equal to one-half of your ex-spouse's full retirement amount (or disability benefit) if you start receiving benefits at your full retirement age.

Full retirement age for folks born 1943-1954 is 66.
